Tewksbury Land Trust
Participant Acknowledgment, Release, and Waiver
1. Assumption of Risk
In consideration of receiving permission from the Tewksbury Land Trust to participate in a trail hike, stewardship activity, or related event, I agree to the following:
I understand the nature of the terrain and/or waterbodies involved in this event and confirm that I am capable of safely participating.
I acknowledge the risks associated with outdoor and remote locations and will take all reasonable precautions to avoid injury to myself, others, or damage to property.
I further understand that if I bring any personal tools, gear, or equipment to the event, I do so at my own risk. The Tewksbury Land Trust assumes no responsibility for loss, damage, or breakage to personal items, whether resulting from use, handling, storage, or environmental conditions.
2. Release of Liability
I am participating in this event at my own risk and acknowledge that the Tewksbury Land Trust makes no warranties or guarantees regarding the condition or safety of the terrain, trails, or any equipment provided.
On behalf of myself, my heirs, successors, and assigns, I hereby release, indemnify, and hold harmless the Tewksbury Land Trust, its Board of Trustees, and Ted Koven Council members from any and all claims, liabilities, losses, damages, costs, or expenses arising from my participation in the event.
This release applies regardless of whether liability is claimed under negligence, strict liability in tort, or any other legal theory of recovery.
3. Compliance with Event Rules
I agree to stay within the areas authorized by the Tewksbury Land Trust and to comply with all safety instructions, event rules, and guidelines provided by Land Trust representatives or event leaders.
4. Photography and Media Release
I grant the Tewksbury Land Trust permission to photograph and/or record video of me during the event.
I authorize these images and recordings, including any containing my likeness or name, to be displayed, published, or used for the Tewksbury Land Trust’s educational, promotional, or archival purposes.
I release, indemnify, and hold harmless the Tewksbury Land Trust, its Board Members, and Ted Koven Council members from any privacy or other claims related to the use of my image or name.
This consent and release are binding upon my heirs, executors, administrators, and assigns.
